List the
major legislative initiatives that have affected the application of assistive
technologies
1)
Rehabilitation
Act of 1973 (Amended)
There are
several pros on this act. The most important aspect would be the
nondiscrimination and reasonable accommodation.
In section 504, of this act it prohibits any activity receiving federal
funds from discriminating solely on the basis of a disability. Section 508 aids
the people that needs the assistance with electronic equipment also it means
that they must make provisions for individuals with a disability so that they
will have equal opportunity. Many organizations and universities have made it
where there places are available for people with or without a disability. It
also provides services so that they will have knowledge of their disabilities.
A great thing about this act is it provides assistance to help aid all people
equal and fair opportunity to gain employment. This legislation has had a large
impact on all persons involved. There is really nothing negative to say about
this act because it has helped so many individuals.
2)
Americans
With Disabilities Act (ADA) of 1990
This act has positive feedback also. It helps
eliminate discrimination in the workforce, all government facilities, public
places, communications, and transportations it also applies to the U.S.
Congress. To be protected by this act all individuals must meet the guidelines
of the Americans with Disability Act. The best part that I like about this act
is that it assists all people with a disability that can’t use regular
transportation ways to be picked up and taken where they need to go. It comes
to the aid of individuals that has hearing, visual and cognitive disabilities.
3)
Individuals
With Disabilities Education Act Amendments of 1997 and 2004
This act gives each and every child the right
to be entitled to a free and appropriate education. Gives assistive
devices to them that is needed, gives
children that has disabilities the right to be educated among their peers,
mandated IEP for each child. The only negative thing is what happens to the
individuals after they turn 21 who need assistance.
4)
Developmental
Disabilities Assistance and Bill of Rights Act
This act provides grants to states for
developmental disability council, university- affiliated programs. It provides
training and technical assistance to improve access with their disability.
5)
Medicaid
This program is based on your income and allows
individuals with assistance toward insurance. It differs from state to state.
It gives screening, diagnosis, and treatment for children 21 and under. There
is a downfall to this, if you are over 21 you are uninsured and that is a major
issue. All individuals need some type of insurance coverage.
6)
Medicare
This program was created by the Social Security
Act in 1965. This program is to assist individuals 65 and older and individuals
with a disability. It is another source funded by the government. Some
assistive technology devices are covered by this program but not all are.
7)
Elementary
and Secondary Education Act (2001 Reauthorization)
This act is known as “No Child Left Behind”
which requires schools to test at least 90% of students with disabilities.
These scores must be recorded with all other children scores determining
whether the schools are making adequate yearly progress. Some states are
developing standards for technology used in education and these are directly
related.
8)
Assistive
Technology Act of 1998 as Amended (2004)
This act assisted with the expansion of
assistive devices and services, advocacy activities and supports grants to
expand and administer other ways of financing of assistive technology systems.
9)
Section 504
of the Rehabilitation Act of 1973
This act requires both assistive technology
services and devices to be included in state vocational rehabilitation services
plans and IPE for each client. This is a great thing because it has made it
where it is mandated to have reasonable accommodation for individuals with
disabilities.
10)
Section 508
of the Rehabilitation Act of 1973
It helps all individuals to have all equal
access to electronic equipment for federal government employees. It defines
rehabilitation technology to rehabilitation engineering.
